North Cowichan – North Cowichan Council will not support the Halalt First Nation’s request to adjourn the court hearing regarding North Cowichan’s Chemainus Well Water Project.

North Cowichan was requested by Halalt on Wednesday, February 24, 2010, to adjourn the scheduled eight-day hearing set to begin on Monday, March 15, 2010, in Vancouver. Previously this matter was scheduled to be heard in January 2010 but was adjourned to March 15, with the consent of all parties, to ensure there was time for preparation.

“We have filed our evidence and would like this matter to be heard,” stated Mayor Tom Walker. “We respect the Halalt’s right to bring this matter before the courts and feel it is now imperative to receive the court’s decision as soon as possible,” added Mayor Walker.

“We have a good relationship with Halalt and provide them with fire protection from our Crofton fire hall and recently agreed to allow both the Penelakut and Halalt First Nations to pump their sewage to our Crofton treatment plant. As most of the bands’ lands are located either within the flood plain land that will not conventionally perc or are located on the aquifer itself, Health Canada has confirmed that sewage disposal by conventional septic tank is not advisable. Being able to install a collection system and pump sewage effluent to Crofton will allow both First Nations to proceed with much needed housing and potentially other development on their lands to accommodate residents. We understand the concern of the larger issues of rights and title, however, North Cowichan is not at the treaty table and these issues are for the federal and provincial governments to resolve in the treaty settlement process,” commented Mayor Walker.

Mayor Walker further noted, “This is about a process–a process that took six years of technical evaluation, discussion and consultation–to get to the point at which the provincial government was satisfied that it could issue an Environmental Assessment Certificate.” The certificate acknowledges that the aquifer has been scientifically evaluated to not only ensure that it can supply domestic needs for the residents of Chemainus, but also to ensure that other wells into the aquifer, including Halalt’s own domestic water well supply, as well as the Chemainus River, are not compromised.

North Cowichan intends to continue construction of the Chemainus Well Water Project as authorized by the Certificate. North Cowichan has entered into contracts and must complete a sufficient amount of the project by March 31, 2010, in order to ensure that $2.5 million in Canada/BC Infrastructure Grant funds are not lost.

Mayor Walker stated, “We have a community that has full expectation of a clean, safe and secure domestic water supply, and timely completion of this project assures that that expectation will be met.”

Halalt filed a petition for judicial review in the Supreme Court of British Columbia on September 3, 2009, naming the Corporation of the District of North Cowichan and the Province of British Columbia, seeking an order quashing the Environmental Assessment Certificate and seeking a declaration that the provincial duties of consultation and accommodation were breached.
